Terms of Use

James O. Hayes Realty, Inc offers services to our customers which require additional terms not listed in our online Legal Statement. To provide these services, James O. Hayes Realty, Inc will negotiate a contract with the customer to determine the extent and type of services to be allowed to be performed via this site.

These Terms of Service form independent agreements between User and James O. Hayes Realty, Inc shall be liable to User for any breach of these Terms. User shall be liable to James O. Hayes Realty, Inc for any breach of these terms including legal charges, system restoration charges or any other damages to JamesOHayesRealty.com’s infrastructure or business processes.

Registration Process 
Use of this service is restricted to adult representatives of James O. Hayes Realty’s clients. User agrees that James O. Hayes Realty, Inc may disclose to third parties certain information contained in Users' registration applications. James O. Hayes Realty, Inc will not disclose any individual User's name, address, email address or telephone number without such User's prior written consent, except to the extent required by applicable laws or in legal proceedings where such information is relevant. James O. Hayes Realty, Inc reserves the right to terminate any User's account if such User has provided false or misleading registration information. James O. Hayes Realty, Inc may also require additional or updated information in order to continue use of User's account.

User Conduct
User agrees to abide by all applicable local, state, and national laws and regulations and is solely responsible for all activities that occur under User’s account or password, including all transmissions through James O. Hayes Realty’s online system. User agrees not to perform any of the following task: 

1. Use JamesOHayesRealty.com in connection with any of it’s internal marketing campaigns or to perform similar services by having access to James O. Hayes Realty’s internal processes, ideas or infrastructure design

2. Interfere with or disrupt networks connected to JamesOHayesRealty.com or violate the regulations, policies or procedures of such networks

3. Attempt to gain unauthorized access to James O. Hayes Realty’s other accounts, computer systems or networks connected to JamesOHayesRealty.com, through password mining or any other means

4. Interfere with another member's use of JamesOHayesRealty.com

5. Create a false identity or forge an email address or IP header, or otherwise attempt to mislead others as to the identity of the sender or the origin of any message 

6. Harvest or otherwise collect information about other users, including email addresses, from JamesOHayesRealty.com

7. Transmit any material that may infringe the intellectual property rights or other rights of third parties, including copyright or trademark

8. Transmit through JamesOHayesRealty.com harassing, unlawful, abusive, obscene, vulgar, threatening, harmful or otherwise objectionable material of any kind or nature

9. Transmit any material that contains viruses, Trojan horses, worms, or any other harmful scripts or programs

10. Violate any U.S. law regarding the transmission of technical data or software exported through JamesOHayesRealty.com

Contents of Data
James O. Hayes Realty, Inc does not, and cannot, monitor, censor or edit the contents of Users' data or information transferred into or through James O. Hayes Realty’s system. Users alone are responsible for the contents of their information. 

James O. Hayes Realty, Inc reserves the right to terminate User's account if it becomes aware and determines, in its sole discretion, that User is violating any of the foregoing guidelines. It is James O. Hayes Realty's policy to respect the privacy of its Users. 

Modifications of JamesOHayesRealty.com
James O. Hayes Realty, Inc may modify or discontinue JamesOHayesRealty.com (or User's account) with or without notice to any User, without liability to any User or any third party.

Modifications of these Terms of Service
James O. Hayes Realty, Inc may modify these Terms of Service from time to time at its sole discretion. James O. Hayes Realty, Inc will provide Users with reasonable notice of any such changes, and the continued use of JamesOHayesRealty.com will be conditioned upon each User's affirmative acceptance of any such changes.

Account and Password
User is responsible for maintaining the confidentiality of its account user name and password. User shall be responsible for all uses of its account, whether or not authorized by User. User agrees to immediately notify James O. Hayes Realty, Inc of any unauthorized use of it’s credentials. 

Disclaimer of Warranties
USER EXPRESSLY AGREES THAT USE OF JAMESOHAYESREALTY.COM IS AT USER'S SOLE RISK. JAMESOHAYESREALTY.COM IS PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS. JAMES O. HAYES REALTY, INC EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY FITNESS FOR A PARTICULAR PURPOSE, WARRANTY OF MERCHANTABILITY OR COPY WRITE INFRINGEMENTS.

JAMES O. HAYES REALTY, INC DOES NOT MAKE ANY WARRANTY THAT JAMESOHAYESREALTY.COM’S WEB SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE; NOR DOES JAMES O. HAYES REALTY, INC MAKE ANY WARRANTY AS TO THE ACCURACY OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH JAMESOHAYESREALTY.COM OR AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF JAMESOHAYESREALTY.COM

USER UNDERSTANDS AND AGREES THAT ANY MATERIAL AND/OR DATA DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF JAMESOHAYESREALTY.COM IS AT USER'S OWN DISCRETION AND RISK AND THAT USER WILL BE SOLELY RESPONSIBLE FOR ANY LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL OR DAMAGE TO USER'S COMPUTER SYSTEM.

Indemnification
User agrees to indemnify and hold each of James O. Hayes Realty, Inc, their subsidiaries, affiliates, officers and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of User's use of JamesOHayesRealty.com, the violation of these Terms of Service by User, or the infringement by User, or any other user of User's account, of any intellectual property or other right of any person or entity.

Applicable Laws
These Terms of Service shall be governed by and construed in accordance with the laws of Georgia, USA.
